Terms of Service
1. Parties and Scope
These Terms of Service (“Terms”) regulate the commercial relationship between ТОВАРИСТВО З ОБМЕЖЕНОЮ ВІДПОВІДАЛЬНІСТЮ "БІГМЕДІА" (BIGMEDIA LLC), with registered address at Україна, 04112, м. Київ, вул. Теліги Олени, будинок 6, корпус “Вест-Сайд”, офіс 3–4 поверх (“BIG Clouding”), and any natural or legal person contracting hosting, email, virtual private server (VPS), or domain services (“Customer”).
2. Services
2.1 Managed Hosting
BIG Clouding provides virtualised infrastructure with managed operating systems, monitoring, backups, and staging environments. Resource allocations are detailed in the selected plan and can be scaled according to availability.
2.2 Managed Email
Business email services include mailbox provisioning, spam and malware filtering, synchronisation across devices, and optional migration assistance. Storage and feature limits follow the contracted tier.
2.3 Managed VPS
VPS plans deliver dedicated compute, memory, and storage resources with optional root access, snapshots, and high availability features. System hardening and updates are performed by BIG Clouding unless otherwise agreed.
2.4 Domain Services
Domain registration, transfer, renewal, and DNS management are offered subject to registry policies and international regulations (ICANN or corresponding authorities). Customers remain the legal holder of registered domains.
3. Ordering and Activation
Orders are placed through bigclouding.com or via authorised commercial channels. Activation occurs once payment is confirmed and the required configuration data is provided by the Customer. BIG Clouding may decline requests that breach applicable law, public order, or internal risk policies.
4. Customer Obligations
- Provide accurate billing and contact information and keep it up to date.
- Use the services in accordance with these Terms, applicable legislation, and accepted internet practices.
- Maintain secure passwords and promptly notify BIG Clouding of suspected security incidents.
- Ensure that hosted or transmitted content does not infringe intellectual property, privacy, or third-party rights.
5. Acceptable Use
The following activities are strictly prohibited: distribution of malware, phishing, sending unsolicited bulk emails, hosting illegal or abusive content, interference with network integrity, mining cryptocurrencies without consent, or any activity that may degrade service quality for other customers.
6. Billing and Renewal
Services are billed on the basis stated during checkout (monthly or annually) in the selected currency. Unless cancelled, plans renew automatically. Invoices are issued electronically. Late payments may result in suspension and interest as permitted by law.
7. Cancellations and Refunds
Customers may cancel at any time from the client area or by contacting support. Refund eligibility depends on the type of service: (a) hosting and email plans include a 14-day satisfaction guarantee for first-time purchases; (b) VPS and domain services are non-refundable once provisioned due to infrastructure allocation and registry policies.
8. Service Levels
BIG Clouding strives for 99.95% monthly uptime for managed hosting and VPS services. Scheduled maintenance windows will be communicated at least 48 hours in advance whenever feasible. Credits for unmet service levels may be requested within 10 business days following the incident.
9. Data Protection
BIG Clouding processes personal data in accordance with its Privacy Policy. By using the services, Customers confirm that they have obtained the necessary consents or have a legal basis to process personal data on our infrastructure.
10. Suspension and Termination
BIG Clouding may suspend or terminate services without prior notice in the event of non-payment, breach of these Terms, court orders, or actions that jeopardise the security or stability of the platform. Upon termination, BIG Clouding will provide access to retrieve data for a reasonable period unless prohibited by law.
11. Modifications
BIG Clouding may update these Terms to reflect legal, technical, or operational changes. Customers will be notified via email or control panel at least 15 days prior to the effective date. Continued use of the services constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of Ukraine. Any dispute will be submitted to the competent courts in Kyiv, without prejudice to mandatory consumer protections.
